Waukesha shooting on Kensington Drive; 18-year-old charged

WAUKESHA, Wis. - An 18-year-old Waukesha man is accused of discharging a firearm at an apartment complex on Sunday, Jan. 19. The accused is Pedro Rodriguez – and he faces the following criminal counts:
- Misdemeanor bail jumping
- First-degree recklessly endangering safety
- Endanger safety by reckless use of firearm

What we know:
According to the criminal complaint, a Waukesha police officer was dispatched on the evening of Sunday, Jan. 19 to a residence on Kensington Drive. A person called 911 reporting a shooting. The victim also "reported that his car had been shot up," the complaint says -- and then identified the shooter as the defendant, Pedro Rodriguez.
When officers arrived on the scene, they located the victim sitting in his SUV. They ordered him to drive to another location, but the victim got out of the vehicle to show his SUV had been shot. The victim also "pointed out the apartment where he believed the shot had come from," the complaint says. The officer noted "the blinds on the window to that unit had a small square cut out of it," the complaint says.
Police then spoke with the victim for more information on what happened. He indicated he had ongoing issues with a person who lived with the defendant related to a stolen iPad.

The night of the shooting, the victim told police he was there to see a person in the apartment below the defendant's. He waved his cellphone flashlight at the person who knew the defendant -- while on the phone with that person. When the victim was leaving, "he heard her say something to the effect of "Don't!" -- and then quickly heard what he believed was a gun shot," the complaint says. The victim said he turned to see the "defendant holding a gun on the balcony of the apartment and that the defendant was sticking out his arm," the complaint says. The victim then drove away -- and called 911. He returned only to get an address for the 911 dispatcher.
More police officers and the police department's armored vehicle arrived on the scene. Law enforcement made attempts to convince the defendant to come out of the apartment building -- which he finally did at 10:39 p.m. The complaint says the defendant was cooperative while being taken into custody.

Later, law enforcement searched the residence of the defendant. There was "a silver unspent cartridge that was a 9mm Luger brand and three brass unspent cartridges, also 9mm Luger brand and three brass unspent cartridges, also 9mm Luger brand, in the defendant's desk drawer. The brass cartridges did appear to match the spent casing from the balcony in both brand and caliber and color," the complaint says. Investigators also located a black magazine under the defendant's bed and a black rifle stock.
Detectives attempted to interview the defendant, but he wished to have an attorney and no questions were asked of him.

Rodriguez made his initial appearance in Waukesha County court on Tuesday, Jan. 21. Cash bond was set at $30,000.
