Waukesha man accused of disturbances, threatening officer

A 44-year-old Waukesha man faces a slew of criminal charges for allegedly creating a disturbance at two businesses and allegedly threatening an officer. The accused is Nathan Estes – and he faces the following criminal counts: 

  • Battery to a law enforcement officer
  • Threat to a law enforcement officer
  • Disorderly conduct (two counts)
  • Misdemeanor retail theft
  • Obstructing an officer
  • Carrying a concealed knife
  • Felony bail jumping (three counts)
  • Misdemeanor bail jumping (two counts)

According to the criminal complaint, Waukesha police were dispatched on Thursday, Jan. 23 to a business on Commerce Street. A caller indicated "a suspect had come into his business and threatened to kill him, and he wished to file a formal complaint," the complaint says. The suspect also threatened to "burn this place down." The caller told police the man left on a red bicycle. The caller, while on the phone with a 911 dispatcher, followed the man on the bicycle. He eventually saw an officer confront the man who had been in the store and "tase him, which did not appear to work, because the man did not fall down. (The caller) saw that the officer and the man were struggling with each other in the street, and the officer was telling the man to get down. (The caller) stated he then ran over and grabbed the man from behind and took him to the ground until another officer arrived," the complaint says. The officer was struck on the right side of her face during this incident and she suffered a small cut on her cheek.

The defendant was placed under arrest after backup officers arrived on the scene. When officers searched Estes, they found a concealed pocketknife, the complaint says.

Investigators later learned that the defendant had entered another business in the same timeframe and been disorderly there as well, the complaint says. The defendant is accused of walking into the store and taking a soda without paying for it. When a worker confronted Estes and told him the soda cost $1, he stated, "I don't have the (expletive) money," the complaint says. When the worker told the defendant to leave the building, the defendant stated," Are you going to make me?" The complaint says the defendant squared up with the worker and stated "I'll kill you. Do you want to be on TV? That's one way to be on TV."

According to the criminal complaint, the defendant was taken to Waukesha Memorial Hospital for medical clearance. While at the hospital, the defendant "became belligerent and profane again," the complaint says. Estes told the officer, "'Almost took the gun and shot you with it. You lucky I didn't.' The defendant also stated to (the officer), 'You're lucky I didn't hurt you.' He also stated, 'Remember honey, I don't steal, I kill. Alright? That's from Nate. Me to you, alright? I'll kill you with kindness,'" the complaint says.

Estes made his initial appearance in Waukesha County court on Friday, Jan. 24. Cash bond was set at $30,000.
