SENTENCED: More than one year in prison for 30-year-old man accused of stalking 13-year-old girl

WAUKESHA COUNTY (WITI) -- Accused of stalking a 13-year-old girl, 30-year-old Shannon Bailey will spend one year and six months in prison.

Bailey was sentenced on Monday, October 13th.

His sentence includes two years of extended supervision. He has been ordered to have no contact with the 13-year-old victim or the victim's family -- and additionally, he has been ordered to have no access to Facebook or any health caring website (like Caring Bridge) or any site of that nature.

Bailey has also been ordered out of the state once his sentence is served.

Bailey initially faced four charges in the case. He pleaded guilty to a felony charge of stalking, and three misdemeanors were dismissed.

Officers were dispatched to the area of Saratoga Road and Ruben Drive in Waukesha on March 31st -- for a report of a man sitting underneath a tree at that location. There, officers came upon Bailey -- who said he was homeless. He was advised about homeless shelters in Waukesha -- and was told he cannot sleep in the streets.

That same morning, according to the criminal complaint against Bailey, a caller had reported him wandering around in the area of Misty Lane and Saratoga Road, carrying a backpack and a pillow case. The caller was worried because her home had been broken into in the past.

The complaint says police also received a call from a woman reporting Bailey walking around in her neighborhood. The complaint says she told police Bailey has been harassing her 13-year-old daughter through social media -- saying she believes Bailey wants to marry her daughter.

Police caught up with Bailey in the area of Bluemound Road and Springdale Road, and he was advised he is not to be anywhere near Saratoga Road due to concerns for the 13-year-old girl.

The complaint says Bailey told police he has "every right to be wherever he wants to be," and said "his belief in God, who has the ultimate authority, does not dictate where he can be."

Bailey was advised by police as to the 13-year-old girl's mother's concern over his alleged infatuation with the girl -- to which Bailey said it is not any concern of the girl's mother's, and it is the girl's decision as to whether she wants to be with him, according to the complaint.

The complaint says Bailey recited numerous quotes from the Bible -- saying "the laws of God do not pertain to the laws of man" -- and that he has "every right to go and do what he believes God is asking of him, and what is in his heart."

The complaint says Bailey indicated he wants to be with the 13-year-old girl.

According to the complaint, Bailey told officials he had moved from West Virginia, and had sold all of his possessions so that he could be with the girl. He told police his heart tells him that he has no sexual desire for the girl -- but said he wants to be her friend and help her through some medical issues, according to the complaint.

Police advised Bailey he was to be nowhere near Saratoga Road -- and was sent on his way with a warning he would be arrested for loitering if he was to return.

Police then spoke with a man who said he is the owner of the building where the 13-year-old girl and her mother live. He inquired to police about getting a restraining order against the man to protect the girl and her mother, according to the complaint.

The complaint says police talked with the 13-year-old girl's mother. The complaint indicates she was "extremely upset, crying and shaking" and said she didn't know what to do -- saying she was "very concerned and scared for the safety of her daughter."

The complaint says the girl's mother told police about a year earlier, the girl had been going through some medical issues, and they had posted to social media information about a service being held at a local church in the girl's honor. That's when the girl's mom says Bailey came into the picture.

The complaint says the girl's mother told police Bailey wrote numerous posts on Facebook saying he needed to see the girl and be with her. The girl's mother says he showed up at the girl's church service and refused to leave. The police were called, and Bailey was served with a municipal citation for harassment, according to the complaint.

The girl's mother told police Bailey showed up at Children's Hospital when the girl was being treated there and asked to see her. He was asked to leave the hospital several times, and eventually had to be escorted off the premises, according to the complaint.

On the afternoon of March 31st, the girl's mother again called police to report she had observed Bailey less than a mile away from the girl's residence -- at a bus stop. At that point, the complaint indicates the girl's mother had received a temporary restraining order, but it hadn't yet been served. A Sheriff's deputy was en route to the area to serve the restraining order.

Officers again met up with Bailey -- who continued to say it was not his concern that the girl's mother was upset with him -- and said he can go anywhere he wants to, and do whatever he wants to. The complaint says Bailey told police "his heart and the Lord is telling him he needs to be with the girl," according to the complaint.

Bailey was served with the temporary restraining order, and advised if he violated it, he would be arrested.

The complaint says Bailey told police the restraining order will not stop him from seeing the girl -- and said he needed to hear from the girl that she does not want to be with him. Bailey was asked if there was anything the police could say or do to prevent him from having contact with the girl -- and he said there was nothing anyone could do to stop him, according to the complaint.

According to the criminal complaint, Bailey tore up the restraining order and said the police's laws and beliefs do not pertain to him because he has beliefs that are based on the Bible and the Lord is telling him what do to.

Bailey was once again advised that if he had any contact or was seen in the area of Saratoga Road, he would be arrested.

The criminal complaint says the 13-year-old girl's mother gave police a more detailed statement on Bailey -- saying that in late 2012, her mother had told her about a man who was offering prayers for her daughter and her medical issues. She wasn't sure how the man had found out about the girl -- but says she set up a blog on the CaringBridge.org website to post about her daughter's progress.

The girl's mother says Bailey was allowed to post on the CaringBridge site -- but was blocked within a week because he was posting large blocks of Bible verses and emailing the girl's grandmother for information on the girl. The complaint says the girl's grandmother eventually stopped responding to Bailey's emails.

The girl's mother told police she is living in fear of Bailey -- saying she is "extremely fearful" for her daughter's safety because she has medical issues and may not be able to defend herself. The girl's mother told police she is "in constant fear for her daughter," and "constantly check's Bailey's (social media) pages to keep tabs on him, because she is afraid of him," according to the complaint.

The complaint says the girl's mother told police she has been living in fear of Bailey since the day he showed up at the hospital -- asking to see her daughter.

On April 1st, police returned to the area to make sure Bailey had left the area -- but they found that he was still in the area. In fact, according to the complaint, Bailey was just a few houses away from the girl's home, and would have been able to maintain a view of the residence. Because Bailey was said to be homeless and apparently living at a shelter in Milwaukee with no ties to Waukesha -- police determined him to be lingering in the area -- and it was determined there was probable cause to arrest Bailey for stalking, and violating the temporary restraining order, according to the complaint.

Police approached Bailey, and the complaint indicates Bailey refused to remove his hands from his pockets. The complaint says Bailey was yelling at an officer -- and placed himself in a pre-attack posture, even after the officer got out his taser.

The complaint says an officer deployed his taser, and Bailey was taken to the ground. However, the complaint says an officer could not get control of Bailey's left arm -- and he had to be repeatedly told to "stop resisting." An officer delivered knee strikes and strong-arm hand strikes and Bailey was taken into custody, according to the complaint.

As Bailey was being placed under arrest, the complaint says he stated: "This isn't gonna change anything."

The complaint says Bailey continued to resist officers' attempts to place him into a squad car, and a transport van and restraint chair had to be delivered to the scene.

On April 1st, officers were ready to transport Bailey from the Waukesha City Jail to the County Jail. According to the complaint, officers found Bailey lying flat on his stomach, with his head down, his left hand in a clenched fist position and his arms tucked tightly underneath his body.

The complaint says Bailey was advised not to resist, and Bailey made no movement or indication that he understood or even acknowledged statements from officers.

The complaint says officers were worried Bailey would ignore them, and then when they entered the cell, he would assault them. Bailey again had to be tased in order to be safely handcuffed, and was then transported to the Waukesha County Jail.
