The backstory
According to police, officers were in the area of 7th and Arthur around 9:30 p.m. on Monday, Jan. 6 in search of a suspect, now identified as Arner-Ortiz, who was wanted for child sex crimes.
Officers learned where Arner-Ortiz was and made contact with him. While talking to him, police said he pulled out a gun. A struggle ensued over the weapon, and an officer pulled out his own gun and shot Arner-Ortiz.
What we know
The case began on Nov. 7. Court filings said a parent in Alsip, Illinois – roughly 17 miles southwest of Chicago – woke up that day and discovered his 13-year-old son wasn't home. The parent searched the victim's computer and found a conversation with someone who arranged to pick the boy up early that morning.
Prosecutors said the parent sent a message to that person and received a reply from the victim, who gave a phone number for the parent to call. The victim said he was with a "friend" who took him to a party in the West Dundee, Illinois area – roughly 50 miles away – and he would be home that afternoon. The boy ended the call, and when the parent called back, an "unknown adult male" answered. The parent then filed a missing person report in Illinois.

Through the investigation, court filings said police learned the victim was in Milwaukee – not West Dundee. Milwaukee police found him at a McDonald's near 6th and Oklahoma, but he "refused" to provide any information about how he got to Milwaukee.
Later, the complaint states the victim told Alsip police that he "ran away" with someone who he'd been talking to online. He said the person took him to Milwaukee, and they had sex at the person's home. He described the person as his "boyfriend" and claimed the person was 16 years old.
Court filings said the victim had been chatting online with the "boyfriend" for three years. The victim later identified the boyfriend as "Emilio Arner." His cellphone and laptop were turned over to Alsip police. Following his arrest in Milwaukee, police also seized a number of electronic devices from Arner-Ortiz – as well as the gun he pointed at officers.
What's next
The officer who shot Arner-Ortiz was identified as a 35-year-old man with more than eight years of service. He will be placed on administrative duty, which is routine after officer-involved shootings.
The Milwaukee Police Homicide Unit will investigate the police shooting.
In all, Arner-Ortiz is charged with:
- Second-degree sexual assault of a child under 16 years of age
- Abduction of a child
- Child enticement
- Use of a computer to facilitate a child sex crime
- Intentionally pointing firearm at law enforcement officers.
It is unclear when Arner-Ortiz will appear in court.
