The lawyer for the family of Ashli Babbitt is planning to sue the U.S. Capitol Police and the unidentified officer who fatally shot her during the Jan. 6 riot in which she was killed. 

After a weeklong trial, a New York man was found guilty and could face up to 10 years in prison for threatening to kill members of Congress in the wake of the pro-Trump Jan. 6 riot at the U.S. Capitol.

The FBI says they were tipped off about the since-deleted photos and videos on Facebook, which helped them find and identify the man and woman in police officers’ body cam footage. They’re both now charged with assaulting officers.

A New York man was arrested and charged in connection with the Jan. 6 riot after he allegedly bragged about storming the capitol to a match on the Bumble dating app. The messages were screenshotted and sent to authorities.

Experts say it's unlikely these defendants can mount a viable defense on First Amendment free speech grounds, but some seem intent on trying.
