MINNEAPOLIS (FOX 9) - Federal Border Patrol agents fatally shot a Minneapolis man, 37-year-old ICU nurse Alex Pretti, Saturday morning. This is the third shooting involving federal agents this year, including that fatal shooting of Renee Good by an ICE agent on Jan. 7.
Federal authorities say the man who was shot was armed. Border Patrol Commander Greg Bovino did not state if the man pulled a gun or where the gun was when he was shot. The man had a legal permit to carry, is a U.S. citizen and lives in Minneapolis, according to Minneapolis Police Chief Brian O'Hara.

Protesters have gathered at the scene of Saturday's shooting. Chemical irritants are being used on the large crowds. Minneapolis Police Chief Brian O'Hara called the protest an unlawful assembly.
The shooting comes the day after thousands of Minnesotans took to the streets in subzero temperatures for a peaceful march and rally calling on ICE to leave the state.

3 p.m. - BCA got search warrant, was still blocked from scene
The Minnesota BCA was blocked from accessing the scene of the fatal Minneapolis shooting on Saturday. The BCA also secured a search warrant, which is unusual for this type of situation, and they were still denied access to the scene.
"The public in the state of Minnesota expects that when a person is killed in one of our communities, an independent, thorough and transparent investigation is conducted into that incident to fully understand what occurred when any law enforcement authority is involved in a deadly force encounter, Minnesotans not only expect this, but they deserve this," the Minnesota BCA Superintendent Drew Evans says.

A 37-year-old Minneapolis resident was fatally shot by a Border Patrol agent Saturday morning during a targeted immigration operation. Rob Doar with the Minnesota Gun Owners Law Center reacted to Saturday's incident.
The Minnesota Gun Owners Caucus released a statement on the fatal shooting of Alex Pretti:
"We are deeply concerned by this morning’s reports that a federal law enforcement operation in Minneapolis resulted in the fatal shooting of 37-year-old Alex Pretti by federal agents. According to local officials, the man was legally armed, a firearm was recovered at the scene, and he is believed to have been a lawful gun owner and permit to carry holder.
"Many critical facts remain unknown.
"We do not yet have an independent account of what initiated the encounter or what triggered the use of deadly force. Despite widespread speculation regarding intent, there has been no evidence produced indicating an intent to harm the officers. We are calling for a full and transparent investigation by both state and federal authorities.
"Every peaceable Minnesotan has the right to keep and bear arms—including while attending protests, acting as observers, or exercising their First Amendment rights. These rights do not disappear when someone is lawfully armed, and they must be respected and protected at all times."
2:50 p.m. - BCA initially blocked by DHS at shooting scene
The Minnesota BCA says it responded to the scene and were initially blocked by federal agents from accessing the scene to investigate.
Gov. Walz has said the state will investigate, saying earlier "the federal government cannot be trusted to lead this investigation. The state will handle it. Period."
It's unclear what the BCA has been able to get access to to investigate the shooting.
In Renee Good's fatal shooting, the BCA was initially asked to help. But then the FBI blocked the BCA from investigating.

"The federal occupation of Minnesota long ago stopped being a matter of immigration enforcement. It is a campaign of organized brutality against the people of our state. And today, that campaign claimed yet another life.
"I have seen the video. It is sickening. But Minnesota’s justice system will have the last word. It must have the last word.
"As I told the White House in no uncertain terms this morning, the federal government cannot be trusted to lead this investigation. The state will handle it. Period.
"All of us understand the potential this incident has to further inflame tensions on our streets. The difference is, we want calm, and they want chaos. We cannot – we will not – give them what they want by meeting violence with violence.

Hennepin County Sheriff Dawanna Witt requested assistance from the National Guard. Here's that announcement:

MN Gov. Walz addresses fatal Border Patrol shooting in Mpls
Minnesota Governor Walz spoke to the media about a man who was fatally shot by a Border Patrol agent in Minneapolis.
Walz said this federal operation in Minnesota stopped being about law enforcement. He's watched the videos of the shooting, calling it "sickening." He said the man who was shot is a lawful firearm carrier.

Border Patrol Commander Greg Bovino says federal law enforcement has been "under attack" in Minneapolis. Bovino said officers fired "defensive shots" at the man, who was armed.

House Speaker Lisa Demuth (R-Cold Spring) and Republican Floor Leader Harry Niska (R-Ramsey) released the following statements today:
"Today we had another tragic loss of life, and I am heartbroken for the loved ones affected," said Speaker Demuth. "As we saw yesterday, thousands of Minnesotans were able to peacefully demonstrate without a single incident. Unfortunately there are still too many political leaders urging direct confrontation including the attempted disruption of law enforcement operations and throwing of dangerous objects. These dangerous tactics put lives of officers and the public at risk. We can have protest. We can have lawful monitoring of ongoing law enforcement operations. But it’s going to take leadership at all levels of government to turn down the temperature. I spoke earlier this week with Vice President Vance, who expressed both publicly and privately a sincere desire to foster better cooperation between the federal government and state and local officials."

At about 9:03 a.m. Minneapolis police received a report of a shooting by federal officials, Minneapolis Police Chief Brian O'Hara said. Officers arrived and found a man with multiple gunshot wounds. He was taken to the hospital, where he was pronounced dead.
O'Hara said he's a 37-year-old white man, a Minneapolis resident. They believe he's an American citizen. He is a lawful gun owner with a permit to carry.
O'Hara believes more than one law enforcement officer fired their weapons.
O'Hara said they have not been told official reports of what led to the shooting, but he has seen the video.
"Our demand today is for those federal agencies that are operating in our city to do so with the same discipline, humanity and integrity that effective law enforcement in this country demands," O'Hara said.
O'Hara is urging everyone to remain peacefully, recognizing there's a lot of anger and questions about what happened. There is an unlawful assembly at this time, and Minneapolis police have given warnings to the crowd to disperse.
"We are asking for people to avoid the area and to leave. If you are there. We have requested mutual aid from the Minnesota State Patrol and from all our local and county regional partners. We ask everyone to remain calm and to please do not destroy our own city," O'Hara said.

When a supposed "peaceful" protester brings a weapon (such as a loaded handgun) and brandishes it, there are going to severe consequences and repercussions. We have pleaded with and warned the media and the politicians that their irresponsible, hate-filled and false rhetoric is going to get people unnecessarily hurt, or worse, killed when they portray our agents and officers as the aggressors. They have encouraged these reckless confrontations and attacks on our agents and officers who are performing their lawful duties and enforcing the laws that Congress has put on the books. The fake and dishonest media and the shameless politicians should be held accountable for willfully misleading the public and enticing these protesters and agitators. We have full confidence that when more facts are revealed, our agents and officers will be shown to have utilized justifiable force in eliminating the threat."

The City of Minneapolis said it is "aware of reports of another shooting involving federal law enforcement in the area of 26th Street W and Nicollet Ave." Video from the scene shows the aftermath of the incident.
DHS released a statement on the shooting on social media. Here's what DHS claims happened:
"At 9:05 a.m. CT, as DHS law enforcement officers were conducting a targeted operation in Minneapolis against an illegal alien wanted for violent assault, an individual approached US Border Patrol officers with a 9 mm semi-automatic handgun," the post says. "The officers attempted to disarm the suspect but the armed suspect violently resisted. More details on the armed struggle are forthcoming.
"Fearing for his life and the lives and safety of fellow officers, an agent fired defensive shots. Medics on scene immediately delivered medical aid to the subject but was pronounced dead at the scene. The suspect also had 2 magazines and no ID—this looks like a situation where an individual wanted to do maximum damage and massacre law enforcement.
"About 200 rioters arrived at the scene and began to obstruct and assault law enforcement on the scene, crowd control measures were deployed for the safety of the public and law enforcement. This situation is evolving, and more information is forthcoming."
