One dead following fight in McDonald's drive-thru; one person in custody



MILWAUKEE (WITI) -- Milwaukee Police are investigating a fatal accident that occurred at 1:39 a.m. in the McDonald's parking lot near 25th and W. National.

A yellow tarp drapes over a car in the parking lot at McDonald's as police gather evidence on Friday, October 3rd -- the scene after sunrise was just as dismal.

Customers still can't believe that just hours earlier a man was killed.

Police say the victim, a 29-year-old man from Milwaukee and his 26-year-old friend from Burlington were going through the drive-thru when they began to argue.

Witnesses say it got physical, the two got out of the vehicle and began to fight.

"I was walking by and just happened to see them pushing each other. I thought it was just going to be a little push here and there and leave because they are friends," said witness, Mario Cutsforth.

Shortly after, authorities say the 26-year-old got back in the vehicle and started to drive away, but struck his friend who apparently jumped in front of the car. The victim died at the scene.

The driver did stay on scene and was taken into police custody. Those nearby the restaurant shake their heads at such a tragedy.

"It's the family that has to deal with it. He has to deal with it and sit in jail and realize I killed my friend over an argument. We as humans need to change, we as people need to change as a race and culture," said witness, Adam Villodas.

No names have been released at this time, and it's unclear if charges will be filed.

McDonald's released a statement:

"This is a very sad and tragic incident. Our sincerest sympathies are with the family of the victim."
