First appearance in court: Darrin Malone charged in shooting death of gas station clerk

MILWAUKEE (WITI) -- You could call him the last man standing, but now he's doing so behind bars. 28-year-old Darrin Malone was the last of three suspects arrested in connection with a fatal shooting at a Waukesha gas station.

Malone made his first court appearance on Wednesday, February 25th after eluding authorities for about a month. He is charged with felony murder, party to a crime.

On January 13th, two masked men robbed a Waukesha gas station. Prosecutors say one of them was Malone. They say the other was 19-year-old Kenneth Thomas -- who allegedly shot and killed the store clerk, 65-year-old Saeed Sharwani.

Malone is charged with felony murder even though he did not pull the trigger -- because someone died while a crime was being committed.

Thomas and Jerica Cotton, the alleged getaway driver, are also in police custody.

On Wednesday, the state requested $75,000 cash bail for Malone -- which was granted. Malone is believed to be connected to other robberies in recent months. He'll be back on court on Friday for a preliminary hearing.
