Flowers lie on the ground Monday outside the home where Davis was shot and killed. Witnesses tell FOX6 News, Davis' older brother, Ronnie Polk, was horsing around with a gun when it went off, hitting Davis in the chest.

"It's under investigation and we've talked to several people. There were several people in the residence, but prior to talking to (Polk), I'm not gonna have any further comment on that," Capt. James Veeser with the Sheboygan Police Department said.

Witnesses insist the shooting was an accident. They say Polk would never shoot his own brother.

Police recovered the weapon, a 9 mm Glock, used in the shooting.
