42-year-old Milwaukee man charged with breaking three-month-old child's leg

MILWAUKEE -- A 42-year-old Milwaukee man has been charged with physical abuse after his three-month-old child was taken to the hospital with a broken leg in October of 2015.

According to a criminal complaint, the child was left in the care of his father, 42-year-old Andrew Freeman, at approximately 7:30 a.m. on October 17th, 2015.

The complaint states Freeman told officials the child was fussy on and off from approximately 8:00 a.m. to 11:30 a.m. Freeman told authorities he fed the baby several times but each time the child was more fussy and wouldn't take the bottle.

Officials say the child's mother came home at approximately 12:30 p.m., when she found the child lying on his back in bed and she noticed his face looked distorted. She told authorities the child "was swollen around his neck area and he looked blue."

The child's mother, and Freeman, then took the child to St. Agnes Hospital in Fond du Lac, where he was then med-flighted to Children's Hospital.

According to the complaint, the three-month-old suffered a laceration to his tracheal area, bruising to the face, right lower leg, and tongue -- and a fractured left leg.

The child underwent surgery and the injury found was a one-centimeter laceration to the right posterior pharynx. Officials say some type of object mechanically caused injury to the child and the reason for the swelling around his neck and upper chest area.

Freeman was taken into questioning and was asked about the child's injury to his throat, to which Freeman responded, "I didn't stick anything down dude's throat."

Andrew Freeman has been charged with one felony count of physical abuse of a child - intentionally cause great bodily harm.

He faces up to 40 years in prison and $100,000 in fines.
