MADISON (AP) -- A Wisconsin appeals court says a lawsuit filed by former Veterans Affairs Secretary John Scocos against the state may continue.
The Board of Veteran Affairs let go Scocos after he returned from a military tour of duty in Iraq in 2009.
Scocos was dismissed from his position because of problems at the agency that he had led since 2003, according to board members. He sued, alleging that the board had violated his right to return to his old job after a military deployment.
The state did acknowledge Scocos' right to keep his job, but also argued "sovereign immunity" that it had from a law that protects such workers from being fired with cause.
On Thursday, June 28th, the court said the state's argument wasn't persuasive.
Scocos was recently reappointed to head Veterans Affairs.
