BURLINGTON -- 54-year-old Joseph Diem of Burlington has been charged with OWI (fifth offense) and resisting an officer for an incident that occurred on Monday, January 7th in the Town of Raymond.
The criminal complaint indicates a Racine County Sheriff's deputy discovered Diem passed out behind the wheel on Three Mile Road facing westbound at 80th Street.
When questioned by the deputy, Diem admitted he had had too much to drink.
The criminal complaint in the case indicates while at the hospital, Diem made suicidal statements and told a deputy he wouldn't speak to him without his lawyer present.
The criminal complaint says Diem became defiant with the deputy at the hospital, swearing at him and refusing to submit to a voluntary blood test. Diem also reportedly threatened to sue -- saying, "by morning, you guys will be out of a job!"
Diem also reportedly resisted when officers attempted to cuff him to transport him to jail.
The criminal complaint states while en route to jail, Diem sobbed, saying he was going to lose his job at Chrysler because of his fifth OWI. Diem blamed the officer for arresting him.
At the jail, Diem was placed on suicide watch due to his suicidal statements.
Diem's previous OWI convictions occurred in 1998, 2002, 2006 and 2008.
