WAUWATOSA (WITI) -- 26-year-old Marcel Malone has been charged in connection with the abuse of his two-month-old child.
Malone faces one count of physical abuse of a child (intentional causation of great bodily harm), and one count of child neglect (bodily harm).
A criminal complaint in the case says the child was taken to the hospital for a broken leg, and was later diagnosed with subdural hemorrhages and a skull fracture.
The complaint says the child's mother left the two-month-old and another child in the care of Malone.
Later that afternoon, officials say the child's mother received a call from a friend who stated she could not get the child to stop crying.
The child's mother returned home, and according to the criminal complaint, noticed the child's leg was badly swollen, so the child's mother called 911.
According to the criminal complaint, the mother's friend told officials Malone was yelling and swearing and exhibiting "bizarre behavior."
The criminal complaint says another child inside the home was interviewed. That child told officials she had been told to stay in her room until her mother got home. The child said Malone was playing video games in the living room when she heard a loud "boom." She rushed into the room, and Malone told her the baby was fine -- according to the criminal complaint.
In a statement, Malone told officials he didn't harm the baby and said the baby had not cried, and said he didn't know what the boom had been, according to the criminal complaint.
When looked at by a doctor, the complaint says a doctor reported that "femur fracture does not occur spontaneously without a significant violent traumatic event. The presence of an unexplained femur fracture in a non-mobile infant is diagnostic of child physical abuse.”
